Job Description

The Advertising Standards Authority is the independent, self-regulatory body for advertising in the UK and works to ensure that every ad is a responsible ad. Our work includes acting on and investigating complaints as well as proactively monitoring and taking action against misleading, harmful or offensive ads, sales promotions and direct marketing.

Compliance Executive

Reporting to: Operations Manager

Location: Holborn, London

Role: 

To ensure compliance with ASA decisions and the advertising Codes by employing a variety of approaches including media and issue specific project work, acting against non-complying companies, co-ordinating sanctions, building relationships with industry stakeholders and  the effective monitoring of ads across all media.   

Context: 

The Compliance team works within the Advertising Policy and Practice Directorate (APP) and carries out work for both the Advertising Standards Authority and the CAP and BCAP Committees.  The Compliance team works with initiative and flexibility to help ensure successful regulation of advertisements.  Confident and diplomatic communication with advertisers, media owners and other stakeholders is especially important, as is the ability to analyse complicated information and achieve rational and proportionate outcomes.

Key Responsibilities: 

Compliance case work

Take prompt action against breaches of the advertising codes that are brought to our attention by other teams in the ASA or by outside parties.  Negotiate with companies to obtain assurances that the relevant advertisements or problematic claims will not appear again.

When an ASA ruling has ramifications for a whole sector, ensure a level playing field by contacting all advertisers in that sector to advise them of changes that need to be made to their advertisements. 

Regularly assess case records to identify advertisers with a poor historical compliance record.  Work with the relevant companies on agreeing mutually acceptable methods to ensure their compliance record improves. 

Write clear and concise alerts warning media owners of issues with particular advertisers.

Help promote the benefits of advertising self-regulation in meetings, seminars and presentations.  Be aware of developments in the broadcast and non-broadcast advertising and regulatory industries.

Monitoring

Work proactively to identify Code breaches in broadcast and non-broadcast media, including teleshopping channels, and take prompt action by negotiating with companies to obtain assurances that the relevant advertisements or problematic claims will not appear again.

Investigate questionable advertisements by asking advertisers to either provide evidence to support their claims or give their assurance that the advertisement will be changed.  Where necessary assess sometimes complicated evidence and produce accurate, succinct, defensible reports for consideration by the ASA Council and, ultimately, publication on the ASA website.

Give post-publication advice to advertisers and agencies on the acceptability of their advertising under the Code.  Suggest creative amendments to potentially misleading advertisements that will ensure their acceptability under the Codes.

Projects

Using a project-management approach, conduct surveys of advertisements in politically-sensitive or previously problematic sectors.  Assess the level of compliance with the Codes and produce detailed reports of the findings for external publication.

Participate in European Advertising Standards Alliance (EASA) monitoring projects.  Monitor ads and provide an overview of their compliance against CAP and BCAP rules together with EU “Common Standards”.  

Undertake other project work identified by the Operations Manager or the wider APP management team to help the directorate meet its annual objectives. 

Stakeholder Relations

Establish, maintain and enhance relationships with key external stakeholders including other regulators, CAP and BCAP members, trade associations and media owners.

Co-ordinate sanctions with industry partners. Manage sanctions and escalate up to and including referral to Trading Standards. Act as a prosecution witness if required in Trading Standards prosecutions

Effectively represent and promote the Compliance team internally through regular attendance at cross-departmental meetings and training sessions.

Help promote the benefits of advertising self-regulation in meetings, seminars and presentations.

Write articles for external newsletters and contribute material for internal and external advertising guidance resources.

Other 

Engage constructively with the Senior Compliance Executives, particularly in relation to the technical aspects of the Compliance Executive role.

Carry out other tasks as identified by the Operations Manager or the APP management team.

Key Requirements:

Communication Skills

Communicate effectively in writing, by telephone and in meetings and presentations with people at all levels across a range of stakeholders including CAP and BCAP members, industry practitioners and other regulators

Excellent report-writing skills; able to write clearly and concisely.

Analytical Skills

Ability to understand, analyse and report complex evidence, including data, sent in support of claims. 

Interpret the key elements of ASA rulings and provide practical and helpful advice to industry practitioners on how to ensure compliance.

Interpersonal Skills

Employ an authoritative, diplomatic, objective, persuasive and robust enough approach to build relationships and resolve sometimes difficult negotiations successfully.

Ability to work independently, use initiative and be resourceful in resolving problems.

Work effectively within a collegiate, team environment; able to motivate themselves and others.

Ability to seek out evidence and other information from a variety of sources including internal databases, the internet and from contacts within the industry.

Organisational Skills

With minimal supervision proactively progress and conclude personal case-work to ensure targets and KPIs are met.

Proven ability to plan, organise and work flexibly under pressure while retaining a high level of accuracy and consistency.

Can maintain a complete, thorough and systematic record of correspondence, evidence and other materials involved in case-work. 

Other

Degree level education or the ability to demonstrate equivalent level of knowledge and experience.

Knowledge of the advertising industry, the advertising codes and key stakeholders.  Experience in a regulatory role or within the media would be useful.
